US government seeks to dismiss pollution lawsuit against xAI Corp

The US Department of Justice has moved to dismiss a Clean Air Act lawsuit against Elon Musk’s xAI, arguing that the case threatens AI projects tied to national military operations. The DOJ filed its motion on June 16, 2026, stepping in to shield xAI and its subsidiary MZX Tech from a lawsuit brought by the NAACP back in April.

What the NAACP is actually alleging

The NAACP’s complaint, filed on April 14, 2026, alleges xAI operates at least 27 unpermitted turbines at the Colossus facility. Some reports put the number as high as 46, with only 15 holding valid permits as of mid-2026.

The NAACP is asking the court to shut down operations until xAI secures proper permits and installs pollution controls. On top of that, they’re seeking daily civil penalties of $124,000 for each violation.

The communities surrounding the Southaven facility are predominantly Black, which adds a layer of environmental justice to the dispute. The lawsuit follows a series of earlier environmental notices of intent dating back to 2025.

The national security card

The DOJ’s argument for dismissal rests on national security grounds. The department claims the NAACP’s lawsuit could jeopardize AI projects that support military operations.

The Colossus facility is central to xAI’s large-scale AI training operations. The company has plans to spend $2.8 billion on additional gas turbine purchases, suggesting the current setup is just the beginning of a much larger energy footprint in the Memphis area.
